Contract Management (Contracts between OMC SOLUTIONS GABON & the client - Contracts between OMC SOLUTIONS GABON & the contracted worker)

Provision of Personnel Contracts with Clients:

  • OMC SOLUTIONS GABON holds the Technical Agreement for personnel provision.
  • Drafting clear and legally compliant contracts in accordance with Gabonese laws, detailing the responsibilities, obligations, and expectations of both parties.
  • Ensuring contract terms comply with labor regulations regarding workforce provision.

Mission Contracts for Contracted Workers:

  • Drafting individual employment contracts in compliance with the Gabonese Labor Code (contract type, duration, salary, benefits, etc.).
  • Managing contract renewals, modifications, or terminations while following legal procedures.
  • All mission contracts are reviewed and signed by the relevant labor inspection authorities.

Salary Management:

  • Accurate and timely salary calculations and payments, including bonuses and benefits, in accordance with legal and contractual obligations.
  • Issuing payroll slips compliant with local regulations.

Social and Tax Contributions:

  • Payment of mandatory contributions to CNSS (National Social Security Fund) and CNAMGS.
  • Declaration and payment of employment-related taxes, such as IRPP, FNH, etc.

Social Benefits Management:

  • Administration of paid leave, health insurance, or any other benefits stipulated in employment contracts or mandated by law.

Creation and Updating of Employee Records:

  • Maintaining complete records for each contracted worker, including personal information, contract copies, work permits, and required certifications.
  • Ensuring up-to-date medical check-ups for contracted workers.
  • Monitoring validity of certifications, training, or other regulatory documents required for the worker’s function.

Work Authorization and Visa Monitoring:

  • Proactive management of work permit and visa applications for expatriate workers.
  • Ensuring timely renewals to prevent any activity interruptions.

Mandatory Declarations:

  • Submitting monthly and annual declarations to local authorities (CNSS, CNAMGS, Tax Directorate, etc.).
  • Maintaining regular communication with the labor inspection office to ensure corporate compliance.

Audits and Inspections:

  • Preparing required documentation for audits or administrative inspections.
  • Quickly implementing corrective actions in response to identified non-compliances.

Regulatory Compliance

Compliance with the Gabonese Labor Code

Ensuring all employment relationships adhere to legal provisions in the Gabonese Labor Code, including:

  • Employment contracts (type, duration, legal requirements).
  • Workers’ rights (working hours, leave, salaries, social security, etc.).
  • End-of-mission procedures (reasons, compensation, legal process).
  • Ensuring expatriate workers possess valid work visas and required permits issued by Gabonese authorities.
  • Complying with quotas or specific requirements regarding expatriate employment versus local workforce, in line with Gabon’s employment policies.

Ensuring compliance with local tax and social obligations, including:

  • Payment of contributions to CNSS & CNAMGS.
  • Adherence to employment-related tax regulations (e.g., income tax, labor-related taxes).

Implementing applicable sectoral or national collective agreements that may specify rules regarding working conditions, minimum wages, or social benefits.

Ensuring HSE guidelines from clients are communicated to contracted workers and guaranteeing that all employees have up-to-date medical check-ups.
